COMPLAINTS 




Dear Customer,

We take care of your rights, including the right to file a complaint. Below you will find detailed information regarding our liability for defects of the sold products and your statutory rights with regard to the complaint - under a warranty. The basis and range of our liability for product defects under a warranty is determined by the applicable laws, in particular the provisions of the Civil Code, and with regard to the sale agreements concluded by 24th December 2014, the Act of 27th July 2002 on special conditions of consumer sale and amendments to the Civil Code (Journal of Laws of 2002, No. 141, item. 1176, as amended.).

We have an obligation to deliver a product without defects. We are liable under a warranty if the physical defect of the product is found before the expiry of two years from the date of the product collection by the buyer. Important! We are liable under a warranty for physical defects which existed at the time of passing the danger to the buyer or resulting from a cause lying in the sold item at the same time.

You can file a complaint, for example:

The complaint should include: (1) information and circumstances concerning the subject of the complaint, in particular the type and date of occurrence of the defects; (2) demand to bring the product into compliance with the Sale Agreement or a price reduction claim or withdrawal from the Sale Agreement; and (3) the contact details of the Customer - which will facilitate and accelerate the consideration of the complaint by the Service Provider. The requirements listed in the previous sentence have the form of recommendations only and do not affect the effectiveness of the complaint made without the recommended description of the complaint. When submitting a claim, you may use our template complaint form, however, it is not mandatory.

Basic rights of the buyer in connection with the product complaint
 
The rights are generally equivalent in nature, which means that it is possible to make use of both the first and second groups of rights right away:

1) Group: price reduction/refund

If a sold a product has a defect the customer can make a statement about the price reduction or withdrawal from the agreement, unless we replace the defective product with a products free from defects or remove the defects promptly and without undue inconvenience. Important! This limitation does not apply if the product has already been replaced or repaired by us or if we did not comply with the obligation to replace the product with a product free of defects or remove the defects.

If the Customer is a consumer, instead of the above mentioned and proposed provisions, it is possible to request exchange of a product for a products free from defects or removal of the defects, unless bringing the product into compliance with the Sale Agreement in a manner chosen by the Customer is impossible or would involve disproportionate costs in comparison with the method proposed by us.
Important! The Customer can not withdraw from the agreement in case of irrelevant defect.

2) Group: repair/exchange

If a sold a product has a defect the customer can request exchange of a product for a products free from defects or removal of the defects . However, we may refuse your request, if bringing the defective product into compliance with the Sale Agreement in a manner chosen by the Customer is impossible or would involve disproportionate costs in comparison with other method.
Please remember that the Customer, who shall exercise the rights under a warranty, is obliged to deliver a defective product at our expense to the following address: ul. Puławska 138A/2 02-624 Warszawa. If due to the nature of the Product or the method of its installation delivering the Product by the Customer would be extremely difficult, the Customer is obliged to provide the product to the Seller in the place where the product is located.

We will address your complaint immediately, not later than 14 calendar days from the date of its filing. Important! No response of the Sellers within the above specified term shall be tantamount to acceptance of the complaint by the Seller.

Additional restrictions connected with the complaint of the product by Customers who are not consumers may be included in the Regulations of our shop.

Other complaints


In the same way as above, you can file a complaint related to the electronic service by using our Online Shop (e.g. Account or Order Form) and other complaints related to the operation of our Online Shop.
The complaint should include: (1) information and circumstances concerning the subject of the complaint, in particular the type and date of occurrence of the irregularities; (2) the claim; and (3) the contact details of the Customer - which will facilitate and accelerate the consideration of the complaint by the Service Provider. The requirements listed in the previous sentence have the form of recommendations only and do not affect the effectiveness of the complaint made without the recommended description of the complaint.
